Reclamation guarantee: how to calculate it, prepare it, and prove it

1. The obligation
- Who: every IUP/IUPK holder at the production-operation stage — before that stage there is no guarantee.
- How much: at least the standard cost in Lampiran II, calculated on the planned clearing area for the first five-year period.
- When: 100% placed within 20 working days of the reclamation plan being approved.
- Form: a time deposit at a government bank, in Rupiah or US dollars.
2. Calculate it in four steps
Guarantee = area cleared (ha) × provincial standard (million Rp/ha, year of work) × commodity factor
Commodity factor: 50% for bauxite, 100% for everything else.
Example A — coal, East Kalimantan, 10 ha, 2026
10 × 162,7 × 1 = 1.627
Rp 1.627.000.000
Example B — bauxite, East Kalimantan, 10 ha, 2026
10 × 162,7 × 50% = 813,5
Rp 813.500.000

5. What decides whether it is approved
The number is the easy part. The file is what gets rejected — usually for the same handful of reasons.
- Clearing area does not match the map and the RKAB
- Topsoil stockpile and nursery capacity not evidenced
- Drainage and acid mine water plan missing from the drawing set
- Five-year staging written as one lump, with no annual target
- Bank guarantee placed late, or the deposit tenor does not match

Apa itu Jaminan Reklamasi?
Dana yang wajib ditempatkan pemegang IUP/IUPK sebagai jaminan bahwa reklamasi lahan bekas tambang benar-benar dilaksanakan. Besarannya paling sedikit mengikuti standar biaya pada Lampiran II Kepmen ESDM 344.K/MB.01/MEM.B/2025.
Bagaimana rumus menghitung Jaminan Reklamasi?
Luas bukaan lahan yang direklamasi (hektar) × standar biaya provinsi pada tahun pelaksanaan reklamasi × faktor komoditas. Khusus bauksit, faktor komoditasnya 50%.
Berapa standar biaya reklamasi per hektar?

Kapan jaminan harus ditempatkan?
Untuk periode 5 tahun pertama tahap Operasi Produksi, jaminan ditempatkan seluruhnya paling lambat 20 hari kerja sejak rencana reklamasi disetujui.
Apa bentuk penempatan jaminan?
Deposito berjangka pada bank pemerintah di Indonesia, dalam Rupiah atau Dolar Amerika Serikat.
